Asset Specific Risks

The following Asset specific risks are incorporated into the Order Form by reference. The Client acknowledges and accepts, in particular (but without limitation to any other actual or potential risks) that:

(i)              transfers in Assets may be irreversible, and, accordingly, losses due to fraudulent or accidental transactions may not be recoverable;

(ii)             issuers of Assets may cease operations, no longer support Assets or modify the characteristics of Assets without notice;

(iii)           issuers of Assets, or participants with a majority of the voting rights, may have, or create, rights in the Assets' underlying DLT network enabling them to restrict, prevent, initiate, or force transactions of, or burn, Assets without notice or remedy;

(iv)           the value of Assets may be derived from the continued willingness of market participants to exchange them for fiat currency or other digital assets, which may result in the potential for the value of the Asset to be highly volatile, and may result in permanent and total loss of value, should the market for that Asset disappear;

(v)            the nature of the Assets may lead to an increased risk of collusion, fraud or cyber-attacks, and may mean that technological difficulties experienced by Komainu or a particular distributed ledger network may prevent the access to or use of the Assets; and

(vi)           the Asset’s underlying DLT network and any smart contracts which the Client may engage with may contain bugs or vulnerabilities which reduce the security of the Asset.

Komainu may update this list of Asset specific risks from time to time in order to reflect new risks, vulnerabilities and intricacies in certain Assets that the Client may choose to acquire, hold, divest or otherwise do business in.

The Client hereby represents that it has completed its own research into any Asset it wishes to acquire, hold, divest or otherwise do business in, including, but not limited to, consulting any applicable whitepaper and audit findings.
